Former Upshur County district clerk charged

Former Upshur County District Clerk Nicole Hernandez has been arrested and charged with tamper with government record, according to the sheriff’s office.

Hernandez was arraigned Friday by Pct. 2 Justice of the Peace Lyle Potter and released from the Upshur County Jail on $3,500 bond. Tamper with government record is a Class A misdemeanor.

Further details were unavailable Friday.

Upshur County law enforcement announced Aug. 30 that it was investigating whether Hernandez mishandled funds while in office. District Attorney Billy Byrd asked the sheriff’s office to conduct the probe.

Hernandez resigned Aug. 29. Her term of office began in January 2023.
