Two Smith County residents arrested on child abuse allegations

Two Smith County residents were arrested Wednesday on accusations of child abuse.

On Wednesday evening about 6 p.m., a Smith County deputy was dispatched to UT Health in Tyler to investigate a suspected case of child abuse.
When the deputy got to the hospital, they were informed by hospital personnel a 3-month-old infant had significant injuries that were consistent with abuse. The infant was undergoing CT scans and X-rays at the time.
A nurse reported the child appeared lethargic, weak and had bruising on the face and neck. A Smith County Crimes Against Children investigator came to the hospital and examined the infant, confirming the injuries.
The investigator spoke with the infant’s mother, who explained the child had just returned home after spending several days with his father, Zachray McGinn, at a residence on the 8900 block of County Road 2192 near Whitehouse. The mother said she had been in contact with both McGinn and his mother, Brittany Mackey, via Facebook Messenger while the child was with them. Mackey is the infant’s grandmother.
On Wednesday, McGinn and Mackey dropped off the child at the mother’s residence, where she noticed the infant’s lethargy and facial bruising. According to the sheriff’s department, the mother was concerned and immediately took the child to the UT Health Emergency Room in Tyler.
The attending ER physician confirmed the infant had a broken right clavicle, and the baby’s right arm was splinted to its chest for healing.

Investigators got a search warrant for the residence on County Road 2192 from 7th State District Judge Kerry Russell.
Upon arriving at the location, both McGinn and Mackey were detained and transported to the Sheriff’s Office. After questioning, investigators prepared arrest affidavits for both individuals.
Russell issued warrants for their arrest on charges of Injury to a Child (Second-Degree Felony), with bonds set at $250,000 each. Both McGinn and Mackey were transported to the Smith County Jail and booked in accordance with the warrants.
