UPDATE: Trooper Abernathy arrested for DWI charge due to Nov. 5 accident

Records released this morning indicate a Texas State Trooper who told authorities he swerved to miss a deer resulting in a crash was intoxicated at the time of the accident.

The accident happened on Nov. 5 at 7:20 a.m. on County Road 262 and County Road 2120.

The trooper, Joe Don Abernathy 61, of Tyler, told investigators a deer ran into his lane of traffic.

He said he swerved to miss the deer and drove off the roadway, overcorrected and then he went across the highway striking several trees.

The Tyler Morning Telegraph has obtained the crash report, which states Abernathy had a blood-alcohol level of .16, which is twice the legal limit.

Investigator David Anthony's report had Abernathy under the charge of driving while intoxicated.

Abernathy was arrested this morning, according to Smith County Assistant District Attorney Matt Bingham.

Abernathy turned himself in to authorities and that a $500 bond was set, according to reports.
