Judge Will Decide Tomorrow If Trial Will Proceed

It is unclear whether the trial for a Tyler woman accused of injecting several clients with a liquid gel substance in February will happen this week in the Smith County 7th District Court.

The clients came to the Queen Divas salon on Martin Luther King Boulevard, which Carmel Mitchelle Foster owns, seeking breast and buttock augmentations.

Ms. Foster, 39, who appeared in court this morning, is charged with two counts of practicing medicine without a license. She faces up to 10 years in prison and a $10,000 fine if she is convicted. Both prosecution and Ms. Foster’s defense attorney, O.W. “Buddy” Lloyd, said in court that they were ready to proceed with the case.

Judge Kerry Russell set Ms. Foster’s case, along with several others for the recall docket at 8:30 tomorrow morning, and he will decide at that time if her case will go to trial this week.
