West Rusk Man Acquitted Of Felony

A Rusk County jury took about 30 minutes to acquit a West Rusk man on a charge of retaliation, a third-degree felony, on Tuesday.
Robert Stanley, 57, faced up to 10 years in prison for the offense, Thad Davidson, one of Stanley’s defense attorneys, said after the trial.
In October 2010, Stanley confronted a woman, Misty Martin, who was taking photos of some property that belonged to Stanley’s son, said Norman Ladd, lead defense attorney. Stanley asked the woman why she was taking photos, and Ms. Martin, who said she worked for a bank, shoved an identification badge with a metal clip on it in Stanley’s face, Ladd said.
Ladd said it was unclear if Stanley sustained any injuries in the altercation.
Ms. Martin called 911, and Rusk County Deputy Ben Reynolds arrived at the scene. “Robert Stanley started telling (the deputy) what happened and he made a movement to show what happened,” Ladd said. Stanley is a Vietnam veteran and suffers from post-traumatic stress disorder, Ladd said.
Reynolds thought Stanley was attacking him and the two got into a physical tussle, Ladd said.
Davidson said he interviewed the jury after it rendered the verdict. “They did not believe there was any retaliation or threat,” Davidson said.
Rusk County District Attorney Micheal Jimerson and First Assistant District Attorney Richard Kennedy prosecuted the case. “The prosecution tried a clean and proper case,” Ladd said.
